East African Crude Oil Pipeline (EACOP) LTD invites experienced and reputable international/local companies or joint venture partners to express their interest in conducting an update of the Human Rights Due Diligence for the EACOP Project in Uganda and Tanzania. The EACOP Project involves the construction and operation of an underground and cross-border pipeline to transport crude oil from lake Albert area in Uganda to Eastern coast of Tanzania for export to international markets. The pipeline will run from Kabale, Hoima district in Uganda to the Chongoleani peninsula in Tanga, Tanzania crossing eight regions – Kagera, Geita, Shinyanga, Tabora, Singida, Dodoma, Manyara and Tanga, 27 administrative district councils and 231 villages. The HRIA update will be conducted across the EACOP project both in Uganda and Tanzania. BRIEF DESCRIPTION OF THE SCOPE OF THE SERVICES EACOP is seeking to update the Human Rights Due Diligence (HRDD) for the EACOP Project as it completes the construction phase and enters the operational phase of the Project. Previously, the EACOP Project commissioned an independent Human Rights Impact Assessment (HRIA) and HRDD Assessment (HRDD Assessment) prior to the construction phase of the Project. Since then, the EACOP Project has developed a governance and management system for ongoing HRDD on the project’s salient human rights issues. The main objectives of the HRDD update are to:

• Review and update the EACOP Project’s salient human rights issues and support the development of an updated Human Rights Action Plan for the operational phase.
• Review the EACOP Project’s current governance and management system for ongoing HRDD and provide recommendations for any necessary adjustments during the operational phase.

Provide stakeholder feedback and expert advice for continuous improvement of the EACOP Project’s human rights performance. MINIMUM REQUIREMENTS

• Interested international/local companies or joint ventures expressing their interest must provide: An outline of the proposed approach and methodology for conducting the (HRDD) Update. Details of design and implementation of similar HRDD projects preferably within EACOP regions, including key elements of the methodology and deliverables. Evidence of previous contracts of similar scope, including reference letters or completion certificates from at least three (3) reputable clients within the past five years. Profiles of key personnel utilized in similar scope including their qualifications and relevant experience.
• Legal registration and regulatory compliance (attach copies): Valid Certificate of Incorporation/Registration, Valid Business Licence (where applicable), Valid Tax Registration and Tax Clearance Certificate, Valid registration on the Supplier database in both countries; For joint ventures/consortia: formal declaration of intent clearly defining the roles and responsibilities of each party. For Joint Ventures (JV): Signed JV Agreement clearly defining scope and country responsibilities.
• Financial capacity: Audited financial statements for the last three (3) years, Bank reference letter demonstrating financial capacity to undertake the assignment.
• Management systems and organizational capability: Evidence of an established Quality Health, Safety and Environment (QHSE) Management system or equivalent management processes applicable to consultancy services, organizational structure demonstrating the firm’s capability to deliver the assignment.
• Ethics and compliance: Evidence of Anti-Corruption and Anti-Bribery policies, Human Rights and Business Ethics policies (where applicable), Code of Conduct or equivalent corporate governance and compliance policies. NOTE: EACOP LTD will review and assess the documents provided by companies that have expressed interest in accordance with this EOI and conduct evaluations based on internal criteria to determine which companies will be included in the list of pre-qualified companies. Only the pre-qualified companies will receive, by signing a Non-Disclosure Agreement (NDA), an invitation to bid as a continuation of the call for tender process. EACOP LTD reserves the right at its sole discretion to make the decision to select or reject a company and maintain its decision without having to give reasons to the company concerned.
