Background and Rationale The Government of Cameroon initiated the Presidential Plan for Reconstruction and Development (PPRD) to address the development needs of the North-West (NW) and South-West (SW) regions and to put these two regions on an upward trajectory. The PPRD is enshrined in the National Development Strategy 2030 (NDS30), aimed at reducing the effects of the socio-political and security crisis for the affected communities in the NW/SW regions. The PPRD also feeds into the government’s efforts to resolve the current crisis. This initiative is complementary to other key reforms such as the establishment of a Special Status for the NW/SW regions. This plan, developed in collaboration with UNDP, , aims to integrate short-term rehabilitation and humanitarian measures with long-term reconstruction and development interventions. The Recovery phase of the PPRD considers the crisis’s impact on all aspects of life and formulates responses designed to have a lasting beneficial impact – to ‘Build Back Better.’ This phase will complement and reinforce current humanitarian efforts by supporting the transition toward civilian-led recovery and the return to normalcy for the Anglophone regions. UNDP focuses on the initial phase of the PPRD as Implementing Partner designated through a ProDoc cosigned with the Government on 5th May 2020, prioritizing human, and social aspects of recovery. The primary focus of the plan related to the restoration of social infrastructure includes restoring and repairing essential utilities and infrastructure, such as schools, health facilities, water, transportation, markets and women centre affected by the crisis. The following 7 (seven) activities are planned: Restoration and renovation of schools. Restoration and renovation of health centres. Restoration and renovation of solar-powered water points. Restoration and renovation of roads and bridges. Rehabilitation of markets. Rehabilitation of agricultural infrastructure. Restoration and renovation of community infrastructure. Rehabilitating damaged and destroyed community infrastructures such as canton courtyards, community halls, women, and youth centres. To ensure the smooth implementation of various infrastructure projects with the required quality and within the established timelines, UNDP recognizes the challenges posed by its engineers’ inability to be present in all project locations simultaneously. Supervision of construction sites ensures that potential construction risks, such as project delays, poor supplier performance, poor workmanship, etc., are quickly identified, documented and reports to guide risk mitigation measures. Again, the exercise ensures that contract variations are processed on time as well as certification of payment. UNDP will also get real time progress reports on the construction projects across a wide geographical area where projects are being implemented. Given the delicate context in which these projects are being executed, along with lessons learned from previous years regarding technical monitoring, UNDP is seeking to engage two engineering firms to provide technical supervision and monitoring of infrastructure projects in the Southwest Region of Cameroon. Therefore, the services required from the engineering firm/consortium of firms is to support field interventions of the Recovery Programme in the NW and SW Regions of Cameroon across all Divisions and selected Council areas supervising all the projects being executed within the duration of the firm’s contract. The selected engineering firm/consortium of engineering firms will be expected to replicate and scale up results that have contributed significantly to proof of concept of the Recovery Programme so far. The firms will deploy their activities under the direct supervision of the Recovery Programme Engineers to supervise project implementation, including but not limited to progress review and assessment of the work of UNDP contractors involved in infrastructure activities. Objectives Overall Objectives The overall objective of this assignment is to engage two (02) qualified engineering firms or consortium (one for each region) to provide technical supervision and monitoring of infrastructure projects in the Northwest and Southwest Regions of Cameroon, across various Division and Council areas ensuring effective implementation, adherence to quality standards, and timely completion of projects while collaborating with UNDP’s Engineers to oversee project execution, assess contractor performance, and replicate successful strategies from previous implementations. Specific Objectives The engineering firms shall perform duties of Project Managers to supervise construction with agreed terms and conditions with UNDP. The firm/consortium will be responsible for: Feasibility studies of infrastructure projects listed in the AWP including other approved project withing the year of implantation. Effective design of feasibility studies of infrastructure projects listed in the AWP and technical supervision and monitoring of infrastructure projects in the Northwest and Southwest Regions of Cameroon, resulting in timely completion, adherence to quality standards, and enhanced community ownership. Short-Term Results Timely conduct feasibility studies for all the infrastructure projects listed in the AWP Improved oversight of construction activities leading to immediate identification and resolution of issues. Enhanced communication between UNDP, the engineering firm/consortium, contractors, and local communities. Increased compliance with technical specifications and contractual agreements during the initial phases of project execution. Establishment of a structured reporting system that facilitates timely updates on project progress. Long-Term Results Sustainable infrastructure development that meets community needs and contributes to local economic growth. Strengthened capacity of local contractors through ongoing guidance and supervision from the engineering firm/consortium. Increased community trust and ownership of infrastructure projects, leading to better maintenance and sustainability. A robust framework for future infrastructure projects based on lessons learned from current implementations, contributing to improved project outcomes in subsequent phases. Scope and Brief Description of Required Services Currently, there are 60 ongoing Infrastructure projects in the NW and SW regions under the Plan, at various stages of completion. Progressively, some will be completed while new others are entering. These are principally related to the renovation of schools, bridges. markets, community centres, health centres and construction of solar powered bore holes and water systems that will constitute the geographic scope of this assignment. The projects are planned to geographically cover all the divisions and councils of the NW and SW regions. More details of the exact locations of the projects will be provided after the award of the contract. Under overall supervision of the PPRD Programme Coordinator and the UNDP Regional Coordinator for the NW and SW regions and with the direct supervision of the UNDP Civil Engineers, the selected engineering firms/consortiums will be responsible for: Feasibility Studies Conducting field inspection and data collection including geotechnical and topographical studies where necessary Producing all the necessary drawing elements Producing all the related structure calculations Preparing the tender documentation Getting all the above validated by the UNDP Engineer Project Supervision and Monitoring Conducting regular (minimum 4 times per month) field visits to all project sites, assessing the progress and quality of work, and ensuring compliance with technical specifications and contractual agreements. Certifying that works are executed as per approved design, drawings, standard specifications, technically sanctioned estimates, and within the provisions of the contract agreement. Carrying out detailed final inspections of the work and recommending to UNDP when the work has been completed as per design, drawings, standard specifications, and contract agreement. Certifying that the construction material brought to the site by the contractor(s) is in accordance with the specifications and tested as per standard practices. Supervising the contractor in all matters concerning safety and care of the work and advising UNDP on any problems arising during construction. Reporting and Documentation Developing standard forms for reporting with UNDP Civil Engineers, including receipt of materials, testing of materials, details of work done along with measurements, etc. Providing detailed reports on project status, identifying potential bottlenecks, and recommending corrective actions to ensure timely completion of activities. Ensuring all genuine concerns raised by the contractor are appropriately relayed and addressed by UNDP while fully respecting technical specifications. Community Engagement Engaging with local community members to gather feedback, address concerns, and foster community ownership of the projects. Risk Management and Quality Assurance Recognizing and defining potential risks and emphasizing mitigation measures. Guiding the contractor on the technical aspects of the project. Properly defining objectively verifiable indicators for improvement in project implementation. Field Data Collection and Validation Visiting as many projects as needed based on a calendar established with UNDP Civil Engineers. Conducting programme monitoring and collecting data and information following a checklist provided by UNDP. Conducting field triangulation of project proposals following UNDP project profile guidelines by capturing all relevant details needed to complete the Project profile (GPS coordinates, site plans, technical designs/drawings, ToRs, pictures, and videos) in collaboration with UNDP Civil Engineers. Reviewing triangulated information and technical supporting documents (site plans, technical designs/drawings, ToRs, pictures, videos). Final Validation and Outcome Data Gathering Supporting in the final validation of the project and technical handover of the project to beneficiaries. Undertaking project impact analysis, surveys, etc., as may be assigned as part of post-evaluation. Variation Orders Management Discussion of all Variation Orders with UNDP Engineers to decide the engagement of each party and to certify the process. Recommending necessary or desirable variations to UNDP, reviewing requests to changes, submitting recommendations, and assisting in negotiating variation orders Recommendation to UNDP regarding costs for works not specified in the contract documents. Keeping records of all variation orders and monitor the total contract costs. Verifying and recommending on variation orders and respective BoQs and providing them to UNDP for further certification and processing. Approach and Methodology The firm shall elaborate a methodology on how it will administer the contract design the feasibility studies and supervise the works in accordance with the contract documents, specifications and drawings. The methodology shall describe in detail all the inputs to be given for these services. In order to achieve the tasks outlined above, the firm shall prepare templates containing the outline, format and content of the activities of the supervision services for the following, inter alia, supervision documents. Field inspection Geotechnical studies Topographical studies Daily site supervision Photo-documentation/recording of the construction activities (before, during, after) Reporting to UNDP (weekly, monthly) Health & Safety component ‘Maintenance & Upkeep Manual’ and its contents Monitoring visits before the final reception of projects Managing the final completion procedures. These templates and their contents will be agreed in consultation with UNDP and can be modified in consultation with UNDP. Deliverables and Schedules The following periodic deliverables are expected:

The firms is responsible for all engineering and administrative works required for supervision. The firms will submit CVs and academic certificate according to the key personal requirement to be reviewed and approved by UNDP and has no right to change any key personal without notifying the UNDP 2 weeks in advance. Any proposed new key personnel shall be reviewed by the UNDP and should obtain minimum same score of the previous key personnel individually. The firms shall exercise all reasonable care to protect the interests of the UNDP, to ensure the timely completion of services within the standards and acceptable quality ensuring resilience. The firms will be responsible for providing the required team of qualified experts and resources capable to perform the services upon award of contract by UNDP. The firms will be responsible to ensure that the services provided to UNDP shall not be shared with any other firms/companies that could ultimately lead toward leakage of internal information to other potential third parties. Such action will severely impact the contract and lead toward termination and imposing a penalty on the firm. The firms proposal should include the cost components such as travel expenses, living allowances if any and as applicable in addition to professional fees. Key Performance Indicators The performance of the service provider will be measured against: Timeliness in Feasibility Studies Ensure that all feasibility studies will be produced on time Timeliness in work progress It is expected from the firms that it will be pro-active in anticipating and preventing any potential issues stemming from the contractor’s inadequate management of the works. The performance of the firms will be measured against the work progress timeliness and that, in case of delays not due to factors beyond the control of the contractor, all reasonable measures were taken to prevent them. Compliance with this indicator will be assessed monthly. In case of unsatisfactory performance two months in a row, UNDP might withhold payments until the service provider has taken all measures to improve its future performance. If unsatisfactory performance continues, UNDP will refer to Article 15 of the General Terms and Conditions for Professional Services. Quality of installed works meeting the requirements of the designs As described in these terms of reference, it will be the responsibility of the firm, as Engineer-in-charge, to ensure compliance of works with the technical specifications and quality standards. UNDP will record cases when the firm didn’t notice non-compliance by the contractor with the technical specifications and quality standards that could affect the overall quality of the final product, namely, cases that were not recorded and addressed by the service provider. The firm will be notified in writing by UNDP if more than 5 cases were recorded and asked to provide a statement on how it will improve its performance. In case of continued unsatisfactory performance under this indicator, UNDP will refer to Article 15 of the General Terms and Conditions for Professional Services. Administration of the contract following UNDP General Conditions of Contract for Works/Services The firm will have the responsibility of contract administration as stated in this Terms of Reference. The contract administration will have to be performed as stipulated in UNDP General Conditions of Contract for Works. Performance of the firm will be measured on how it performs the contract administration in line with the UNDP General Conditions of Contracts. Non-compliance with it will result in grounds for UNDP will refer to Article 15 of the General Terms and Conditions for Professional Services. Governance and Accountability Under overall supervision of the PPRD Programme Coordinator and the UNDP Regional Coordinator for the SW region and with the direct supervision of the UNDP Civil Engineers, the selected engineering firm/consortium will be responsible for providing general technical supervision and inspection support to projects in all project locations of the SW region. In conjunction with other stakeholders of the programme and existing institutional arrangements with national counterparts, UNDP will facilitate access to project sites through formal introductions to local administrative and traditional authorities, including project owners who are in most cases the Council authorities. UNDP has the right to terminate / freeze the contract at two weeks prior to contract termination. UNDP is the only party that gives instructions to the firm. The end-user has no right to give directions directly to the consultancy firm, except through UNDP. Facilities: Travel, lodging, communication, and other costs The price quoted by the supervising Engineering firm shall include all fees including travel, lodging, communication, and any other anticipated costs. To increase the competitiveness of the proposal, the bidder is advised to recruit and deploy qualified civil engineering technicians located within the vicinity of the construction sites, to reduce on the transport and lodging costs, where possible. Expected duration of the contract/assignment The duration of the contract is one (01) year. Duty Station The geographical scope of the assignment is the Northwest and Southwest Regions of Cameroon. The duty station therefore is the Northwest Region and the Southwest Region with Bamenda and Buea being the Headquarters for operational purposes. The Firms/Consortiums must have a fixed address with a physical office space in the NW and SW Regions for their day-to-day administration of the consultancy. Working Language Excellent command of the written and spoken English language. Fluency in Pidgin English is required for all field staff of the firms. A good knowledge of written and spoken French would also be considered an asset. Professional Qualifications of participating Firms and its key Personnel The firms shall be a registered company in Cameroon with a valid tax identification number. Detailed company profile demonstrating a firm with a minimum of 10 years of experience.
