GGGI is seeking Article 6's National Legal Expert  to review existing laws and regulations for data and information collection systems and support the drafting of legal text based on the options and solutions for operationalizing Article 6 of the Paris Agreement in Togo.

Project Background

Based in Seoul, the Global Green Growth Institute (GGGI) is an Inter-governmental Organization founded to support and promote a model of economic growth known as "green growth", which targets key aspects of economic performance such as poverty reduction, job creation, social inclusion, and environmental sustainability. GGGI works with countries around the world, building their capacity and working collaboratively on green growth policies that can impact the lives of millions. The organization partners with countries, multilateral institutions, government bodies, and private sector to help build economies that grow strongly and are more efficient and sustainable in the use of natural resources, less carbon intensive, and more resilient to climate change. 

GGGI has a diverse portfolio of programs in developing countries around the world. These in-country programs, together with global products and services, focus on delivering results through an integrated approach of evidence-based green growth planning and implementation aligned to countries’ development priorities. The organization also focuses on knowledge development and management activities which build a strong theoretical and empirical basis for green growth, while providing concrete options and guidance for policymakers; as well as building the conditions for public and private green infrastructure investments. 

GGGI is supporting the Republic of Togo to embrace the Green Growth transition model, in supporting the management of implementation of Strategic projects and programs. 

Since August 2026, the Global Green Growth Institute (GGGI), in collaboration with the Ministry of Environment, Forest Resources, Coastal Protection and Climate Change (MERFPCCC), invites participants from the public and private sectors to the national meeting for the official launch of the project supporting the preparation and implementation of Togo’s Carbon Transaction Facility.

This project supports the Togolese government, under the leadership of the Ministry of Environment, Forest Resources, Coastal Protection and Climate Change, in implementing Decree 2023-034, which established the governance structure for Togo’s participation in carbon markets. A key component of this project is the update and development of governance frameworks for the Article 6 mechanism (Articles 6.2 and 6.4) and the carbon market, as well as capacity-building and support for the Technical Secretariat for Carbon Mechanism Management (STGMC) and the National Homologation Committee (CNH). 

Article 6 Framework (incorporating the strategic vision) and operations manual will build on existing elements of the carbon market, such as relevant sectors and carbon market definitions contained in the decree. The project also proposes targeted training on Article 6 and decision-support for key CNH members to enhance their capacity to actively engage in international carbon markets. The results of these activities will help Togo scale up its climate action and mobilize finance and technologies to advance toward low-carbon development.

Through this project, GGGI aims to support and strengthen the capacities of the Togolese government, as a host country, to effectively participate in and contribute to the opening of international carbon markets. 

This support will extend through the following two activities/results:

Output 1: Increased awareness and strengthened stakeholder capacities to engage in Article 6 cooperative approaches on an equitable basis

Activity 1.1: Build the capacity of government decision-makers (Technical Secretariat for Carbon Mechanism Management, National Homologation Committee, etc.) on Article 6 concepts

Output 2: Governance framework and institutional capacities for Article 6 developed Activity 2.1: Update and develop the Article 6 Governance Framework, operations manual, and institutional arrangements Activity 2.2: Strengthen capacities for implementing Article 6 Governance Framework of Togo’s  operations manual 

Recently, the Government has taken a formal decision to elaborate a revised decree that will establish a robust national legal and institutional framework aligned with Article 6 of the Paris Agreement, and fully coherent with complementary climate governance instruments.

INTRODUCTION TO GGGI

1. OBJECTIVES

This consultancy aims to engage an Article 6 Legal Expert to support the development of a strengthened legal and institutional framework for operationalizing Article 6 of the Paris Agreement in Togo by reviewing existing laws and regulations and drafting the required legal instruments. Working closely with MERF‑PCCC, the Consultant will produce an implementable Article 6 legal package - including a gap analysis, prioritized legal instruments (law/decree/arrêté), model cooperation agreements and authorization templates, and procedures for authorization, oversight, and tracking - ensuring full alignment with CMA decisions under Articles 6.2 and 6.4 and coherence with national climate governance instruments.

2. SCOPE OF WORK AND KEY TASKS

Task 1 : Legal Gap and Needs Assessment

Map existing national legal instruments relevant to carbon markets and international cooperation (e.g., climate, environment, energy, forests, land, investment, public finance/treasury, taxation, PPP, procurement, sovereign agreements, data protection).

Identify gaps/conflicts vis-à-vis Article 6 participation requirements, corresponding adjustments, authorization regimes, transfer/first-transfer rules, benefit-sharing, safeguards, registry interfacing, and private sector participation.

Deliver diagnostic report with prioritized legal roadmap and drafting plan.  

Task 2: Support the design of Article 6 Participation Architecture

Advise and support the technical team in designing Togo’s Article 6 Participation Architecture, including the definition of institutional roles, coordination mechanisms, decision‑making procedures, and operational workflows for Article 6 activities. 

Task 3: Drafting of Legal Core Instruments

Produce a full drafting package (track-changes, clean versions, and explanatory notes) for priority instruments such as:

Primary or secondary legal instrument that establishes Article 6 participation (e.g., Framework Decree/Arrêté or, if needed, Law ) covering:

Definitions (ITMOs, corresponding adjustments, A6.2/6.4 activity, mitigation outcomes, etc.).

Institutional mandates and decision-making.

Authorization procedures and revocation/suspension.

Corresponding adjustment methods and timing.

Avoidance of double counting measures (domestic registry linkages, inventory linkages).

Benefit-sharing rules and revenue allocation (including local communities).

Safeguards (ESIA alignment, FPIC where applicable, grievance mechanisms).

Data-sharing, transparency, and reporting obligations.

Sanctions/penalties and compliance.

Implementing regulation(s) (if needed) detailing application requirements, review timelines, monitoring/reporting, issuance/first transfer, registry interactions, fees, and disclosure.

Ministerial Order(s) for practical procedures (templates, checklists, forms).

  Task 4: Consultations and Capacity Building

Conduct targeted consultations (public and private sector, civil society, communities, development partners).

Facilitate 2–3 technical workshops (e.g., architecture design, draft validation, finalization).

Produce capacity-building materials and a briefing for decision-makers (Council of Ministers/Parliament as relevant).

Integrate feedback, finalize all legal drafts.

4.  EXPERTISE REQUIRED

Advanced degree (master’s or Ph.D.) with specialization in public international law, environmental/climate, energy, or commercial law.

5+ years legal drafting and advisory experience in climate/energy/environmental regulation; demonstrated work on Article 6 (6.2 and/or 6.4) in at least two jurisdictions (preferably including African contexts).

Strong knowledge of Paris Agreement, CMA decisions, ETF, and carbon market contracts (ITMO/ERPA).

Experience with civil law systems; familiarity with OHADA and public finance/treasury rules.

Strong analytical and quantitative skills, alongside strong synthesis, and strategic thinking skills

Excellent knowledge and familiarity with national law system and stakeholders

Work experience in an African country

Proven experience in establishing and maintaining working relations with officials and technical experts in the government.

Demonstrate experience and success in the engagement of, and working with both the public and private sector, especially in African region is an advantage.

French fluency (drafting quality) required; English proficiency an asset.

Excellent facilitation, consultation, and capacity-building skills.
